Resolved by the Confederate Parliament of the Confederacy of Free Nations, that the following article is proposed as a law under the jurisdiction of the Confederacy of Free Nations, enforceable by all of its institutions.
Be it enacted by the Confederacy of Free Nations, in Confederate Parliament assembled, that
Section 1
Repeal
1. The Discord Establishment, Structure, and Administration Act (L008) is repealed and its provisions are no longer enforceable;
Section 2
Ownership
1. The regional Discord is to be put under quasi-public control. The government of the Confederacy will hold control over the server, but the Consuls shall no longer have jurisdiction over the administration of the server;
2. The ownership account created under Section 1.3 of L008 is to be removed of all of its roles and removed from the server entirely;
3. The regional Discord is to be recognized as ‘regional infrastructure’, with certain requirements for accountability as outlined in the following:
Section 3
Administrative Structure
1. The Discord server for the region is to be administered by the Discord Administrative Organization (DAO) under the control of a Director;
2. The Director and all other members of the DAO are required to be citizens of The Confederacy of Free Nations;
3. The Director is to be given the “Director” role on the server, alongside all permissions including the "Administrator" position;
4. The Director is to be responsible for moderating the behavior on the server and establishing new text and voice channels for the promotion of regional activity. The Director shall also be able to decide the number of moderators on the server, but is not be able to modify their permissions to include or exclude any which are or are not permitted by this legislation;
5. The Administrator is to be given a role which includes all permissions except for the “Administrator” and “Manage Server” permissions;
6. The Administrator shall be responsible for moderating the behavior on the server and shall also have the authority to set up new text and voice channels. However, any decisions made regarding moderation and setting up channels may be overridden by the Director.
7. Moderators are to be given a unique role on the server. The Director shall have the discretion to set their permissions.
8. Moderators are to be responsible for moderating the behavior on the server, being able to remove messages and manage the membership of the region. Any moderation decisions may be overridden by the Director or Administrator.
Section 4
Function
1. The Discord server administered under this Act is to be the sole server shown on the World Factbook Entry;
2. The purpose of the Discord server is to allow the citizenry to communicate with one another in addition to discussing regional activities such as roleplaying insofar as such activity does not eclipse that occurring on the forums;
3. Any posts relating to the government of the Confederacy shall be relegated to a channel dedicated to regional announcements. Otherwise, the Director shall have the authority to remove any other channels dedicated to executive or legislative activity or announcements;
4. The Director shall have the discretion to remove all roles given to government officials, including those of “Consul” and “Supreme Court Justice;”
Section 5
Administration Council
1. The Administration Council (otherwise known as the ‘Admin Council’ or the ‘Advisory Council) is an advisory and oversight body that the Director must form in the case that more than one admin exists on the server;
2. The Director shall serve as the Chairman of this Council, and may take part in its deliberations, but does not possess voting power, unless in the case of a tie, and is not considered a formal member of the council;
3. All Administrators (or admins) on the server are considered to automatically be members of the Council with full voting powers. They may not be removed or hindered from voting unless they are subject to a vote to strip them of their admin powers;
4. Council members may not propose acts or changes to the server, except for the addition of non-admin council members as established in Section 5.5 and in the decision to recall the Director in Section 5.8, and may only vote on acts proposed by the Director;
5. Council members are empowered to invite and enshrine up to 2 citizens of the confederacy as non-admin council members with full voting powers. The Director may not be granted voting powers using this method;
6. The Director must seek the approval of the Admin Council in order to undertake the following actions:
- To appoint or expel a Moderator;
- To appoint or expel an Admin;
- In such a case, the admin subject to the vote may not exercise their voting power;
- To ban a user, except in the case of spam, the posting of adult images in non-adult channels, or in cases where waiting to execute a vote in council may cause harm to the server, region, community or any citizen;
- In such cases where a ban is made without consulting council, a vote must be placed before council to approve the decision retroactively without 24 hours of action being taken;
8. Any Admin member of the Council may propose a recall of the Director to which all members of the Council shall be able to vote in. If successful, an election shall be triggered according to the procedures established in Section 6;
9. In the case that there is only a single Admin, the admin council is not required to exist and instead, the actions established in Section 5.6 must be approved by the admin appointed;
10. The Director is required to evaluate whether there is a need for more admins based on server growth regularly. If there has been a period of significant server growth, and if a citizen requests it, the Director must initiate a vote within the entire DAO on whether to increase the number of admins and publish the results publically;
- In the case that four citizens publicly disapprove of the results of the vote, the Director is required to initiate a vote on whether to increase the number of admins which includes the entire citizenry
Section 6
Electoral Procedure
2. After the election, the Director shall be able to serve for as long as they seek without any reelections or term limits. A new election shall only take place if:
- The Director resigns or is inactive for over one month;
- The citizens of the Confederacy vote to recall the Director by a two-thirds majority;
- The mods vote to remove the Director by a three-fifths majority and with the consent of the admin council, if it exists;
- The admin council (if it exists) votes to remove the Director by a simple majority;
3. If the admin council (if it exists) votes to remove the Director and prevent them from running for office again, then a three-fifths majority is required as opposed to the simple majority required only for removal;
4. Likewise, Administrators shall also be elected using approval voting, with the top candidates (based on the number of Admins that the Director has chosen to have) being elected. They shall also be able to serve as long as they seek without any reelections or term limits unless:
- They are inactive for over one month;
- The citizens of the Confederacy vote to recall the Admin by a simple majority;
- An admin is removed with the consent of both the Director and a majority of the Admin council (if it exists) excluding the member concerned;
5. Moderators may be appointed as required by the Director subject to several conditions:
- In the case that only one admin exists, the Director must obtain their consent in order to appoint or dismiss moderators;
- In the case that more than one admin exists, the Director must obtain the approval of a majority of sitting admins in order to appoint or dismiss moderators;
6. Any recalls from citizens require at least four supporters to take place. The Director shall be required to set up a new channel for petitions to be created for recalls in addition to another channel for recall votes to take place;
7. If the Director is removed under the conditions set forth in Section 6.2, then:
- In the case that only one admin exists, then they will obtain the roles for both their current position and that of the Director until a winner is announced for the Directorship election;
- In the case that more than one admin exists, the Admin Council shall appoint one of their own members as the interim Director until a winner is announced for the Directorship election;
8. The DAO shall have the discretion to find an application to be used for elections. The application must support approval voting and must allow for citizens to view their ballots to verify them;
9. Both recall votes and elections must be conducted in at least a week, with the DAO being able to appropriate more time for them.
